Why rentals and condos matter in San Diego

Most homes in the City of San Diego are rented. The Census American Community Survey (2020–24 5-year) puts the renter share at 52.7%, and 38.0% of housing units are in buildings with five or more units. Shared walls, stacked bathrooms and shared roofs mean a leak in one unit can show up as mold in another.

Tenants: what California law says about mold

Mold can make a unit substandard

Health and Safety Code §17920.3(a)(13) lists "visible mold growth, as determined by a health officer or a code enforcement officer" as a substandard condition. It excludes mold that is minor and found on surfaces that can collect moisture as part of their normal use, such as a shower. "Dampness of habitable rooms" is listed separately.

The landlord's duty starts with notice

Under Civil Code §1941.7, a landlord has no duty to repair that mold condition until the landlord has notice of it. The duty also does not apply if the tenant is violating the tenant duties in §1941.2. The landlord may enter to repair mold with proper notice under §1954. Report mold in writing, date it, keep a copy and add photos.

Repair-and-deduct has strict limits

Civil Code §1942 lets a tenant, after notice and a reasonable time, make a repair that costs no more than one month's rent and deduct it. Acting after 30 days from notice is presumed reasonable. The remedy can be used no more than twice in any 12-month period, and it is not available if the tenant caused the problem. Talk to a tenant-rights resource or an attorney before using it.

Retaliation is restricted for 180 days

Civil Code §1942.5 says that if a tenant is current on rent, the landlord may not recover possession, raise rent or reduce services within 180 days after the tenant complains about habitability, gives notice under §1942, or files a complaint with a government agency, among other events.

Where to report

If written notice does not get results, tenants can contact their city's code enforcement office, or the County in unincorporated areas. If you live in privatized military housing, start with your housing office; that housing has its own maintenance process.

Not legal advice

This page explains general rules in plain words. Your lease and the facts matter. Before decisions about rent, repairs or moving out, talk to a tenant-rights organization or a California attorney.

Landlords and property managers

  • Respond in writing and keep a record of when you received notice and what you did.
  • Any job of $1,000 or more, any job needing a permit, or any job with a crew requires a CSLB-licensed contractor.

Condo owners and HOAs

In a condo, the first question is often who is responsible, not how to clean it. The answer usually turns on where the water came from and what your governing documents say. California's association law was not covered by the research behind this page, so this section stays general. Check your CC&Rs.

  • Read your CC&Rs and any maintenance chart to see which parts are common area and which are yours.
  • Report leaks from roofs, shared pipes or the unit above to the association manager in writing.
  • Ask whether the association's insurance or your own unit policy applies, and check your declarations page.

California rules box: rental and condo jobs

California does not license mold inspection or remediation as its own trade, so checking credentials is up to you. The CSLB classifications show no mold category. You can check a CSLB license (required for repair work of $1,000 or more, any job needing a permit, or any job with a crew, since January 1, 2025), IICRC and ACAC certifications, and an insurance certificate.

Jobs over $500 need a written contract (B&P §7159). Signed at home, Civil Code §1689.6 allows 3 business days to cancel (5 for seniors), and 7 business days for repairs after a declared disaster.

Older homes may still contain asbestos, so testing before tear-out is best practice. County APCD Rule 1206 applies to buildings with 5 or more units (survey, then 10 working days' notice for 100+ sq ft disturbed), not to buildings with 4 or fewer.

City of San Diego permits (IB 203): like-for-like repairs of $1,000 or less with no electrical, plumbing or mechanical work need no permit, including up to 100 sq ft of drywall replaced as part of such a repair. Larger jobs need a No-Plan permit; historic homes are excluded. In other cities, check with your city.

Questions to ask each company

  • What is your CSLB license number for repair work?
  • Which IICRC or ACAC certifications do you hold?
  • Can I see a current certificate of insurance?
  • Will I get a written protocol and scope?
  • Is clearance testing done by an independent company?
  • Does my home's age call for an asbestos check?
  • What caused the moisture, and who fixes it?
  • Will I get a written contract under §7159?

Rental and condo mold questions

What should I do first if I find mold in my apartment?

Tell your landlord or property manager in writing, keep a copy, and take dated photos. Under Civil Code §1941.7, the landlord's duty to repair a mold condition starts once the landlord has notice. This is general information, not legal advice.

Can I withhold rent because of mold in California?

Rent withholding and repair-and-deduct carry real risk if the conditions are not met. Civil Code §1942 has strict limits, including a cap of one month's rent and no more than twice in 12 months. Talk to a tenant-rights resource or an attorney before you withhold or deduct anything. This page is not legal advice.

Who pays for mold in a condo, me or the HOA?

It depends on where the water came from and what your CC&Rs say. A leak from a common-area roof or pipe may be handled differently from a leak inside your unit. California law on association maintenance was not covered by the research behind this page, so check your CC&Rs and governing documents and ask your association manager in writing.

Does renters insurance cover mold?

Often not. The California Department of Insurance (Jan 2026) lists mold as usually excluded and says flood is generally not covered by homeowners or renters policies. Damage to your belongings from a sudden, accidental water event may be treated differently. Check your declarations page.
